  4. The shareware version of the WinFin is provided on an "as is" basis 
  5. for a maximum evaluation period of 30 days.
  6. The registered version is provided with a 30-day money-back guarantee,
  7. provided all materials are returned.

  9. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GJETAAS, INC
  10. DISCLAIMS ALL WARRANTIES RELATING TO THIS SOFTWARE, WHETHER EXPRESSED 
  11. OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF
  12. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  NEITHER GJETAAS,
  13. INC. NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION,
  14. PRODUCTION, OR DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR ANY
  15. INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF THE USE
  16. OR INABILITY TO USE SUCH SOFTWARE, EVEN IF GJETAAS, INC HAS
  17. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.  IN NO EVENT
  18. SHALL GJETAAS, INC'S LIABILITY FOR ANY DAMAGES EVER EXCEED THE
  19. PRICE PAID FOR THE LICENSE TO USE THE SOFTWARE, REGARDLESS OF THE FORM
  20. OF THE CLAIM.  THE PERSON USING THE SOFTWARE BEARS ALL RISK AS TO THE
  21. QUALITY AND PERFORMANCE OF THE SOFTWARE.

  23. This agreement shall be governed by the laws of the State of Washington
  24. and shall inure to the benefit of Gjetaas, Inc and any
  25. successors, administrators, heirs and assigns.  Any action or proceeding
  26. brought by either party against the other arising out of or related to
  27. this agreement shall be brought only in a STATE or FEDERAL COURT of
  28. competent jurisdiction located in Whatcom County, Washington.  The parties
  29. hereby consent to in personam jurisdiction of said courts.
